Appendix E. Henderson Civic Center Alcohol Permit
The Civic Center Alcohol Permit is granted in consideration of the promises, assurances and warranties expressed herein, and upon all of the terms and conditions herein. The following rules have been adopted to govern events where alcoholic beverages are served or provided at the Henderson Civic Center. These rules apply to all events at the Henderson Civic Center regardless of whether the event is sponsored by a City unit, or any other public or private entity or person. All event sponsors must purchase and sign a Civic Center Alcohol Permit for a program or event in which alcohol will be served and/or consumed. The Civic Center provides this permit, which must be signed before the start of the event. The Civic Center Alcohol Permit is separate from the Catering Certificate required by the Texas Alcohol Beverage Commission Strict adherence to these rules is required.A person wishing to host an event with alcohol has two options.
- Private parties not charging admission may bring their own alcohol (BYOB). No direct or indirect sales of alcoholic beverages will be allowed at any BYOB event. The Civic Center Alcohol Permit holder will be responsible for making sure all alcohol is inside the center prior to the event as well as removing all alcohol from the center after the event.
- The lessee may hire a TABC licensed Caterer located in Henderson to serve or sale alcohol during an event. To do so, the Caterer must also apply for and obtain the required Catering Certificate Permit by the Texas Alcohol Beverage Commission. The permit must be issued for the date of the event. The Catering Certificate holder must have the permit at the event. The Certificate holder will be responsible for bringing and removing all alcohol to and from the Civic Center.
In addition to the foregoing rules, the person or entity requesting and signing this Permit acknowledges, represents and unconditionally warrants that they will comply with the following rules, terms and conditions:
- Service or consumption of alcohol will be permitted only between the hours of 5 p.m. and 11 p.m. Monday through Friday and 12 p.m. until 11 p.m. Saturday and Sunday.
- No alcohol shall be consumed outside the Civic Center or on the Parking Lot at any time.
- Proper identification shall be required of each person to consume alcohol when alcohol is served. If identification cannot be provided then that individual may no longer be able to consume alcohol at the event.
- No alcohol will be allowed at any event honoring a minor.
- No glass bottles will be allowed with the exception of wine and champagne.
- BYOB will include beer, wine and champagne only. Mixed drinks will only be allowed when they are served or sold by a TABC Certified Caterer.
- Lessee shall be responsible for providing adequate security as stipulated in Chapter II Section 6 of the Henderson Civic Center Policy and Procedure Manual.
- Any event with attendance greater than 49 persons, where alcohol is consumed, will be required to have security officers present durian the event, while alcohol is consumed .
- The holder of this permit must turn in a floor plan to the Civic Center Director that will specify the location where alcohol will be kept during the event.
- The amount of alcohol consumed by any guest will be the sole responsibility of the Lessee and/or the Daily Temporary Club Permit holder and not the responsibility of the Civic Center. The Henderson Civic Center along with the City of Henderson, its staff and any representatives shall not be liable for any and all injuries, death, or property damage which might occur as a result of allowing alcohol consumption at or in connection with any event at the Civic Center. Any violation of these rules can result in the immediate shutdown of the event and forfeiture of all rent and deposits paid and due.
- Lessee assumes full responsibility for the character, acts and conduct of all persons admitted to said premises during the term of this contract and Lessee shall comply with all laws of the United States, and of the State of Texas, the Civic Center Policies and Procedure Manual, all ordinances of the City of Henderson and all rules and requirements of the Police and Fire Departments, or other Municipal Authorities of the City of Henderson.
- At no time shall alcohol be served or consumed by individuals younger than twenty-one years of age. If alcohol is found at a non-alcoholic event, violation may result in the immediate closure of the event and all paid rent and deposit monies may be forfeited.
- Security officers are authorized to enforce the law, including, but not limited, to public intoxication and minor in possession laws and ordinances.
